Win a holiday to Disneyland Competition

General

  1. Information on how to enter and the Prize forms part of the Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to the Competition, these Terms and Conditions prevail.
  3. Davinksi Nominees Pty Ltd, trading as Market Square Shopping Centre and Managed with ABN 60005202184 by Knight Frank Pty Ltd, Market Square Shopping Centre Geelong, Corners Malop and Moorabool Streets Geelong, VIC 3220, is the promoter(Promoter).

How to Enter

To enter the ‘Win a Holiday to Disneyland’ competition (Competition) run by the Promoter, customers must:

  1. Make a purchase of a product at either the store of a Participating Retailer to receive an entry form (Entry Form).
  2. Complete all the details on the Entry Form.
  3. Submit the Entry Form into the barrel located at Centre Court Market Square during the Promotion Period.
  4. Retain a copy of the receipt relating to the purchase at the store of a Participating Retailer as proof of purchase.
  5. A customer who complies fully with these Terms and Conditions will be validly entered into the Competition (Entrant)

 Prize Terms and Conditions

  1. The prize for the Competition is a five (5) night holiday to Disneyland California, including return flights, for four (4) people [two (2) adults and two (2) children (for the purposes of the Competition, ‘children’ are considered to be aged 11 years and under)] supplied by Helloworld Travel Geelong Market Square (Prize).
  2. The Prize is a “Travel Package” and is only redeemable from Helloworld Travel Geelong Market Square, and consists of the following:
  • Return economy airfares for four (4) people (two (2) adults and two (2) children (for the purposes of the Competition, ‘children’ are considered to be aged 11 years and under)] to a maximum value of $5,100. ($1450 per adult and $1100 per child). The winner of the Prize is liable for any flight costs above this value;
  • Five (5) nights’ accommodation staying at a (minimum) 3-star hotel in Anaheim(including breakfast) to a maximum value of $2,700 (Accommodation);
  • Return transfers from the airport in Los Angeles to the Accommodation, valued at $300;
  • A three (3) day Disneyland Pass per person, valued at $1,900;
  1. The total value of the Prize is a maximum of $10,000 (Prize Value).
  2. All other travel costs in excess of the Prize Value are at full cost and responsibility of the winner of the Prize and their companions, including but not limited to passports, visas, insurances, medical costs, Australian airport transfers, meals, spending money and additional tours.
  3. The Prize must be booked through Helloworld Travel Geelong Market Square by 30th November 2017, and Prize must be redeemed by 31st May 2018 or it becomes void.
  4. Blackout periods apply and all bookings are subject to availability, supplier change and cancellation fees.
  5. All requests for itinerary changes must be made to Maxine Leske of Helloworld Travel Geelong Market Square or another representative nominated by Helloworld Travel Geelong Market Square, and are at full cost and responsibility of the winner of the Prize and their nominated companions.
  6. The Prize cannot be redeemed or exchanged for any other form of travel services or cash.
  7. The Prize is a single-use Travel Package. Any unused portion of the Package is forfeited and is not redeemable for cash or other forms of credit.
  8. All bookings are subject to availability at the time of booking and all applicable booking terms and conditions of the Accommodation supplier and Helloworld Travel Geelong Market Square.
  9. The Prize will be deemed fully redeemed once a qualifying booking has been made and confirmed to be available. The Prize will not be reinstated, refunded or replaced, even in the event that the reservation is cancelled or changed.
  10. Changes or cancellations may incur charges from airlines, hotels or other suppliers. The winner of the Prize is responsible to pay any such charges and the Prize cannot be applied to any additional costs associated with changes or cancellations to the original booking requested by the winner of the Prize.
  11. There is no residual value and no credit will be issued if the booking amount is less than the Prize Value.
  12. The winner of the Prize may add services or stay additional nights; however the winner of the Prize is responsible for any additional costs.
  13. All taxes, fees, charges and surcharges applicable to the booking for the Prize, including but not limited to for an extra person, phone, parking and other charges, are applicable to the winner of the Prize’s reservation, and Prize cannot be applied to them. These charges must be paid at the time the reservation is confirmed or to the hotel property directly and are the responsibility solely of the winner of the Prize.
  14. The Prize is void where it is prohibited or restricted by law.
  15. The Promoter reserves the right to change these Terms and Conditions without notice and at any stage during the Competition.

Who Can Enter

  1. This promotion is only open to Victorian (Australia) residents.
  2. If the winner of the Prize is under the age of 18 years, the Prize will be awarded to the winner’s nominated parent or guardian. Such parent or guardian is to be nominated on each Entrant’s submitted Entry Form if the Entrant is under the age of 18 years.
  3. Employees and the immediate families of the Promoter and participating retail stores (Participating Retailers) are ineligible to enter. Immediate family means parents/step-parents, spouses and children.

 Duration of Competition

The competition opens at 9.00am Saturday 23rd September 2017 and closes 5.00pm Monday 6th November 2017 (Promotion Period).

  1. The Promoter warrants that the Participating Retailers have provided written consent that they will promote, and be associated with, the Competition, and to offer customers the chance to submit an Entry Form for the Competition upon the purchase of a product at their store.
  2. The Promotor warrants that that the Participating Retailers have provided written consent that they will not use Entrant’s personal information and details except in accordance with these Terms and Conditions.

 General Conditions of Entry                                                                                                                   

  1. One (1) Entry Form will be given per transaction at the store of a Participating Retailer.
  2. Customers may enter more than once, but each entry must be completed in full to be considered valid, and the receipt retained as proof of purchase.
  3. Entries received after 5.00pm Monday 6th November 2017 will not be considered eligible for the Competition.
  4. Neither the Promoter or the Participating Retailers accept responsibility for late, lost or misdirected Entry Forms.
  5. Entry forms will not be accepted for the Competition via post or electronic communication.
  6. Entry Forms that are deemed by the Promoter to be illegible, forged, mutilated, copied or tampered with in any way will not be considered eligible for the Competition.
  7. Receipts from tobacco products or non-Participating Retailers cannot be presented as receipts to enter the Competition.
  8. The winner of the Prize must provide suitable photo identification (e.g. driver’s licence) to the Promoters’ satisfaction to be entitled to claim the Prize.
  9. The winner of the Prize must be able to present receipt for the purchased product at a Participating Retailer as proof of purchase in order to claim the Prize.
  10. The Promoter reserves the right to verify the validity of entries and to disqualify any Entrant who tampers with the entry process or who submits an entry that is not in accordance with the Terms and Conditions of Entry.
  11. The Prize Value is correct at the 23rd September 2017 commencement date of the competition and the Prize Value is based on the recommended retail price. The Promoter is not responsible for any subsequent variation in values.
  12. The Prize is not redeemable for cash and not transferable and must be taken as offered.

 Date, Time and Place of Draws

  1. The winner of the Prize will be drawn via a random draw at 11.00am Tuesday 7th November at Market Square Shopping Centre, Corner Malop & Moorabool Street, Geelong, VIC, 3220 (Prize Draw). An Entrant is not required to be present at the Prize Draw to be eligible to win the Prize.
  1. The result of the Prize Draw is final. No further correspondence will be entered into regarding the result of the Prize Draw.
  2. The winner of the Prize will be contacted by phone and in writing after the Prize Draw has taken place using the contact details provided on the Entry Form.
  3. The winner of the Prize’s name will be published on the Market Square website marketsquaregeelong.com.au and other social media outlets operated at the time by Market Square Shopping Centre within 72 hours of the Prize draw and will be displayed for a minimum period of 28 days on this website.
  4. If, despite every reasonable effort, the winner of the Prize cannot be contacted, the Prize will be retained for a period of 1 month. At the end of the 1 month, being 7th December 2017, if the Prize remains unclaimed, there will be a redraw. Any redraw/s will be conducted at Market Square, Centre Management Office, Corner Malop & Moorabool Street, Geelong, VIC, 3220.

 Customers Information

  1. By submitting an Entry Form in the Competition, Entrants give the Promoter and participating Retailers consent to use their personal information for further promotional purposes , unless the Entrant specifically requests that such personal information not be used for promotional purposes by the Promoter. Or the Entrant opts-out at any time from the promotional and other marketing messages.
  2. The Promoter agrees to keep confidential all personal details obtained by the Promoter during the Promotion Period and agrees that such information will be used for the purposes of the Competition or the further promotional purposes outlined above only.
  3. If the customer choses to accept the Prize, the Promoter reserves the right to use the customer’s name and photograph for marketing and publicity purposes.

 Privacy Collection statement

  1. The Promoter warrants that records will be kept for a minimum of three years after finalisation of the Competition that provide an accurate financial accounting of the Competition, an accurate accounting for all entries, and an accurate reporting of the distribution of the Prize.
  2. The Promoter and its related entities collect Entrants’ personal information for the purpose of conducting and promoting the Competition (including but not limited to determining and notifying winners) and for the purpose disclosed in these Terms & Conditions.
  3. The Promoter will handle Entrants personal information in accordance with its Privacy Policy available at: http://www.marketsquaregeelong.com.au/privacy/
  4.  Liability

  1. The Promoter and the Participating Retailers and their respective employees, agents and contractors accept no responsibility for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for any personal injury suffered or sustained as a consequence of the use and enjoyment of any item gained via the Prize, except for any liability which cannot be excluded by law.
  2. The Promoter and the Participating Retailers accept no responsibility for any tax implications that may arise from the Prize winnings or the use thereof. It is the responsibility of each Entrant to seek independent advice on the possible implications this may have on their own financial situation.
  3. Unless due to fraud or ineligibility under these Terms and Conditions, all valid Prize claims in excess of the advertised Prize Value will be honoured.
  4. If for any reason this Competition is not capable of running as planned, including by infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration security, fairness, integrity or proper conduct of the Competition, then the Competition will be suspended subject to the approval of the relevant gaming authorities in Victoria if necessary.
  5. The Promoter reserves the right to disqualify any individual from the Competition who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition subject to the approval of the gaming authorities where required.
  6. If all or any part of any term or condition contained in these Terms and Conditions shall be declared or become unenforceable, invalid or illegal for any reason, such term or condition (or part thereof) shall be deemed severed from these Terms & Conditions and the other terms and conditions hereof shall remain in full force.

 Copyright, Statutory Guarantees, Waiver and Liability

  1. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received provided it is in accordance with these Terms and Conditions and the Promoter’s Privacy Policy available at: http://www.marketsquaregeelong.com.au/privacy/.
  2. Any cost associated with accessing any website promoting the Competition is the Entrant’s responsibility and is dependent on the internet service provider used.
  3. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the State and Territories of Victoria (Non-Excludable Guarantees).
  4. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize Value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of the Prize. Any change in the Prize Value occurring between the publishing date and date the Prize is claimed is not the responsibility of the Promoter.

Experience With Us Terms and Conditions of Participation

  1. Information on participation in Market Square’s “Experience With Us – Freebies for over 50s every Tuesday” (The Promotion) forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. All participants are required to meet the entry criteria outlined in Terms and Conditions.
  2. The Promotion is open to those aged over 50 only who attend Market Square Shopping Centre, Corners Moorabool & Malop Streets, Geelong, Victoria, 3220 (Market Square).
  3. Employees (and their immediate families) of the Promoter (Market Square Shopping Centre) are ineligible to enter.
  4. To participate eligible individuals must claim their ‘freebie’ on a Tuesday at Market Square Shopping Centre in person. Freebies will not be given to a third party.
  5. Only one redemption can be made per eligible person.
  6. The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s age) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  9. Participants agree that photos may be taken for promotional use at the discretion of Market Square Shopping Centre for the use of promotion and must notify Centre Management if they do not wish their photo be to be used or taken.
  10. Where personal data is collected as part of the redemption process, the personal data will be handled strictly in accordance with current Privacy Legislation. Market Square’s privacy policy can be found at http://www.marketsquaregeelong.com.au/privacy/
  11. When personal data is collected, participants will be joined up to the Market Square VIP Club Membership program and will receive marketing communications from Market Square.
  12. Freebies must be redeemed on the day of redemption. Freebie is void if it’s not collected or redeemed on the day of promotion.
  13. Failure to use the freebie forfeits the freebie and the promoter or its associated agencies take no responsibility for loss, damage or unused freebies.
  14. If the participant is unable to comply with The Promotion’s terms and conditions, then they forfeit the redemption.
  15. Redemptions are non-transferable and cannot be exchanged for cash or sold.
  16. If The Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any participant.
  17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of the offer.
  18. The Promoter may collect personal information in order to conduct The Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, offer suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. The Promoter will use the personal information provided in accordance with their Privacy Policy which can be found at http://www.marketsquaregeelong.com.au/privacy. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
  19. The Promoter is Davinksi Nominees Pty Ltd, trading as Market Square Shopping Centre and Managed by Knight Frank Pty Ltd, Market Square Shopping Centre Geelong, Cnr Malop and Moorabool Streets Geelong, VIC 3222.
